2021.09.16 21:04 Lokky Am I responsible for deterioration to a structure that occurred because the contractor waited months to start working?
Almost a year ago I hired someone to replace the floors on my front porch and back deck. The work was delayed because we ordered composite boards and they didn't come until march, by which point he had some big project go wrong, and long story short he is finally now finishing up the front.
As part of the back deck, the contract states that he will replace the damaged joists, cover them with an under-deck waterproofing system, then lay the composite board on top. When this was written, we had identified only a handful of damaged boards. Last week, I noticed that the central beam, to which all the joists are attached, rotted to the point that a giant mushroom is growing from it and the whole thing has gone soft to the touch. This beam seemed in perfectly good shape as of March, and the waterproofing system was going to completely seal it off and prevent any water from reaching it, effectively protecting it from the damage that led to the current situation.
Am I on the hook for the labor and material for replacing this beam, or should I expect the contractor to handle it, since we are now coming up on 1 year from when we signed the contract and six months since he started dragging his feet about actually working on my house?

The propagation of electromagnetic waves is often explained as the electric and magnetic fields repeatedly creating each other: electric field creates magnetic field which creates electric field which creates magnetic field... and so on.
But isn't this misleading? The wave equations for the electric and magnetic fields are separate equations where E does not depend on B. Therefore, the electric and magnetic fields creating each other is not the reason we have propagating waves, right?
If we imagine that magnetic fields somehow didn't exist in physics, we would still have a wave equation for E. Therefore, we would still have waves propagating at the speed of light, right?

I recently went through a pretty intense MTB training for work (yes I know getting paid to ride a bike for work is awesome) but I’m still a beginner and looking for any advice. I’ve been trail riding a few times but really want to get into it more. I’ve ridden a double black Diamond before and did alright (had to walk a few sections). I can confidently go up and down stairs. But not good at jumping at all. I ride a Trek Marlin 6 for now.
Any advice or tips would be awesome!

My info gets sent up to MEPs tomorrow and was wondering if anyone has not had to have a waiver for a surgery. It was a minor ankle surgery. Got a handwritten letter from my surgeon saying my ankle is perfectly okay and its hard to distinguish one ankle from my other aside from a surgical scar. And anyone have a timeline on how long it took for your waiver to get through?

My work place (medical practice)in Australia asks us to sign employment contracts every year. I have done so for the past 10 news without any complaint. I work permanently part time and for the last 2 to 3 years I have worked permanently part time elsewhere. Before signing this current contract I checked the award I noticed that rather than having my hours defined to the part time hours that I work, (Monday 8.30am - 3pm, Friday 8am - 6.15pm and every second Saturday alternating between 7.45am -1.30pm and 8am-12pm) and have done for years, the current contract states "Span of hours" which is the ordinary hours covered under the award ie, Monday to Friday 7.30am until 9pm and Saturday 7.45 am until 1:45pm (the Saturdays in the contract are incorrect, but I'll get to that in a minute.)
The award is legislated and states that;
"A part-time employee is employed to work less than 38 hours per week. An employer and employee have to agree on a regular pattern of work before the employee starts. The agreement has to be in writing and include:
the number of hours worked each week
the days of the week the employee will work
the start and finish times each day
The employer should keep a copy of the agreement, and give a copy to the employee."
This has never happened. All we have ever been given is an employment contract with " Span of hours" which is mon-friday. So to be correct and working within the award,(legislated) they need to do this for every employee because we all work part time, as well as have employment contracts. So two separate documents right?
The problem that I now have is that I work permanently part time elsewhere and feel that I need to protect my other job by having the hours that I work at the clinic defined so they can't just change the days I work thus affecting my other job. (When this management took over they did change all the hours/ days we all worked, so it is a legitimate concern) Little did I know that they were already supposed to be doing this! When I approached my manager about it, she told me I was wrong and that the owners of the business could change my regular pattern of work whenever they wanted if they gave me 7 days notice and why was I worried about it since they know when I'm avaliable and would never ask me to work on days that I'm not avaliable? (I've also since learnt this is not true either) She told me that she can approach the owners of the business and ask them if I can "define my hours to the regular pattern of work which is Mon AND Friday and every 2nd Saturday only, but if they choose to keep the contract the same and I refuse the sign it, I need to make a choice as to whether I want to keep my job as I am unable to remain employed unless I sign an employment contract. I was so annoyed by how defensive she became, because duh, she's a manager, it's her actual job to manage! I even pointed out to her that she was becoming defensive and I couldn't understand why and that I loved my actual job and had no complaints. But because of her reaction I rang fairwork and spoke to them (Turns out I was right), and kept looking at the award. Turns out, (going back to Saturday shifts) according to the award (which again is legislated) the "ordinary" hours that can be worked on a Saturday are 8am - 4pm. Now at my clinic we have x2 staff that work a Saturday. One shift is 7.45am - 1.30pm and the other is 8am- 12pm
Now the problem is that the extra 15mins (7.45am - 8.00am) is supposed to be paid at overtime which is 150% of the normal Saturday rate. (This has NEVER HAPPENED!) So the clinic has not only been breaking the law, by not having part time working agreements in place for their staff, but they have been underpaying all their staff that have worked the 7.45am shift for at least the past 10 years. Now mind you, the current management has only been in place for the last 4-5 years, so this is a carry over from the last manager. But current management have no training in management at all, they don't know how to communicate, and clearly don't know the award and are such assholes and there is no give or take. Just for context; the old manager gave us six weeks annual leave per year instead of the 4 in the award and paid us Saturday rates even if the clinic closed as it was out of our control. We could leave early if we were done for the day and still get paid for what we were rostered to work.
Current management took away the extra 2 weeks annual leave "as the business couldn't afford it" and if we close on a Saturday we have to make up the hours we would have worked during the week and it is only paid at normal rate. And forget leaving early. No way. (Apparently only management can do that) Management are paid a combined $65 per hour between the two of them and they work the same days and have a long weekend every week and are accountable to no one. Finance just made mention that the Doctors pays were so high that they had to double check them to make sure they were right, so the business must still really be in trouble right?
Question is what do I do? I love my job but I'm a single mum with a mortgage. I need it. But how can I let them get away with this bullshit? Is it worth it? How can I go about this and hold them accountable and still keep my job??
